Terms and Conditions

1. Introduction

Welcome to PitchIn Platform ("Platform"), provided by PitchIn Platform Limited. These Terms and Conditions ("Terms") govern your use of our web-based platform, including the registration and management of organizations and the facilitation of payments for a wide range of fundraising activities. By accessing or using our Platform, you agree to comply with and be bound by these Terms.

2. Definitions

  • "Activities" refers to a broad range of fundraising activities, including but not limited to sponsorships, donations, memberships, events, and other initiatives, which may involve one-off or subscription-based payments.
  • "Organization" refers to any entity, including but not limited to sports clubs, charities, community groups, or other organizations, registered on the Platform.
  • "Platform" refers to the web-based platform known as PitchIn Platform, provided by PitchIn Platform Limited.
  • "Third-Party Payment Processors" refers to Stripe and GoCardless, which process payments on behalf of Organizations.
  • "User" refers to any individual or entity registering and using the Platform.

3. User Registration and Account Management

3.1 To use the Platform, Users must create an account and provide accurate and up-to-date information.

3.2 Organizations are responsible for managing their accounts, including maintaining the security of their login credentials.

3.3 Organizations must register with and manage their payment provider accounts with accepted Third-Party Payment Processors (e.g. Stripe and GoCardless) independently. PitchIn Platform is not responsible for any issues arising from these payment provider accounts.

4. Use of the Platform

4.1 Organizations may use the Platform to facilitate a variety of Activities, including setting up and managing payments for fundraising initiatives of their choosing.

4.2 Payments facilitated through the Platform may be one-off or subscription-based. The terms of these payments will be determined by the Club.

4.3 Organizations must ensure compliance with applicable laws and regulations when conducting Activities on the Platform e.g. Small Society Lottery Licenses.

4.4 Organizations are entirely responsible for the management and delivery of Activities, including ensuring their successful execution and fulfillment of commitments made to supporters.

4.5 Organizations using the email marketing feature provided by the Platform are solely responsible for ensuring compliance with all applicable data protection and privacy laws, including but not limited to the General Data Protection Regulation (GDPR). While PitchIn Platform facilitates the management of email marketing unsubscribes to assist compliance, Organizations remain responsible for ensuring the lawful use of email communications and managing their email marketing campaigns.

5. Payment Processing

5.1 All payments are processed through Third-Party Payment Processors (e.g. Stripe and GoCardless). Users agree to comply with the terms and conditions of these processors.

5.2 PitchIn Platform Limited is not responsible for any fees, delays, or errors related to payment processing.

5.3 Clubs are responsible for managing their payouts and resolving any disputes with Third-Party Payment Processors.

6. Fees and Charges

6.1 PitchIn Platform charges a service fee which is stated on the PitchIn Platform Pricing page. These fees are subject to change with reasonable prior notice.

If the Third-Party Payment Processors increase their charges to PitchIn Platform Ltd then PitchIn Platform can increase the service fee (above) without notice.

6.2 Third-Party Payment Processors may impose their own fees for payment processing, which are separate from any fees charged by PitchIn Platform Limited.

7. Liability and Disclaimers

7.1 PitchIn Platform Limited provides the Platform on an "as-is" basis and does not guarantee uninterrupted or error-free operation.

7.2 PitchIn Platform Limited is not responsible for:

  • Payment disputes between Organizations and their Users (i.e. supporters).
  • Any loss, damage, or liability arising from the use of Third-Party Payment Processors.
  • Compliance with tax or legal obligations related to Activities conducted on the Platform.
  • Compliance with gaming legislation such as small society lotteries

7.3 Users acknowledge that they use the Platform at their own risk.

8. Termination

8.1 PitchIn Platform Limited reserves the right to suspend or terminate any User account for violation of these Terms or misuse of the Platform.

8.2 PitchIn Platform Limited reserves the right to suspend or terminate any Organization account for violation of these Terms or misuse of the Platform.

8.3 Users may terminate their account at any time by providing written notice to PitchIn Platform Limited.

8.4 PitchIn Platform Limited reserves the right to suspend or terminate any User or Organization account without cause giving no less than 14 days notice.

8.5 PitchIn Platform Limited reserves the right to suspend or remove specific services from the Platform such that they will no longer be available to Users with 14 days notice.

9. Intellectual Property

9.1 All intellectual property rights related to the Platform, including but not limited to trademarks, copyright, design rights, database rights, logos, and software, remain the exclusive property of PitchIn Platform Limited.

9.2 Users are granted a limited, non-exclusive license to use the Platform solely for its intended purpose of fundraising per the terms of the platform from registered Users on behalf of registered Organizations.

10. Privacy

10.1 PitchIn Platform Limited will handle User data in accordance with its Privacy Policy, which can be found at https://www.pitchinplatform.com/privacy-policy.

10.2 Users agree to the collection and use of their data as described in the Privacy Policy.

11. Governing Law and Dispute Resolution

11.1 These Terms are governed by the laws of the United Kingdom.

11.2 Any disputes arising from the use of the Platform will be resolved through negotiation. If unresolved, disputes will be subject to the exclusive jurisdiction of the courts in the United Kingdom

12. Amendments

12.1 PitchIn Platform Limited reserves the right to update or modify these Terms at any time. Users will be notified of any significant changes.

12.2 Continued use of the Platform following changes to the Terms constitutes acceptance of the revised Terms.
